ABOUT THIS PRIVACY NOTICE

This Privacy Notice discusses how Hostway collects, maintains, uses, and discloses the information that is collected from you, our customers, the visitors to our website, and any individual who contacts us directly (altogether, “Users”). The purpose of this Privacy Notice is to provide Users with an understanding of what types of information we collect, how it is stored, why we use it, and the choices that Users have related to this information. We want to ensure that you understand how we will and will not use the information you entrust to us.

If you are a Hostway customer (“Client”), this Privacy Notice is incorporated into and subject to the Master Services Agreement (“MSA”) (available online at https://hostway.com/legal/ or as otherwise executed between yourself and Hostway) which governs the services provided by Hostway (“Services”).

If you are only visiting our website, you will not be required to identify yourself or reveal any personal information as you browse online. However, if you wish to initiate any communications with Hostway via our website, such as using the online form to request a sales quote or using the live chat function to speak with a customer service agent, you may be asked to first provide certain personal information to identify yourself to us. If you do not wish to provide this personal information, you may continue to browse our website, but we will not be able to contact you. Once you choose to provide us with your personal information (or any other information by which you can be identified), you can be assured that it will only be used to support your relationship with Hostway as detailed herein this Privacy Notice.

We reserve the right to change this Privacy Notice at any time. Your rights and obligations in relation to the Processing of Personal Data will be as set out in GDPR, this Privacy Notice, and, if you are a customer, the MSA.

To ensure our compliance with GDPR, Hostway engages a trusted independent third-party provider to review our GDPR readiness, which is in addition to our standard SOC and PCI-DSS audits. If, after you conduct a data protection impact assessment or consultation with a supervisory authority you determine that continuing with our Services would be in breach of GDPR, then you must notify Hostway immediately and we will work together with you to reach a mutually agreeable solution.

The term “Client Information” will also include information maintained by Hostway with regard to your customer account status, choice of Services, and access logs. In addition, we may store your electronic mail and other communications as a part of the transmission and delivery of those communications as a part of your Client Information. Client Information contains information by which Users can be personally identified.

HOW DO WE COLLECT YOUR INFORMATION?

By Asking You Directly

If you indicate to us that you would like to receive communications from Hostway, we will ask you to provide us with your User Contact Information. If you sign up as a Client, we will ask you to provide us with your Client Information. You will be provided the opportunity to actively consent to Hostway’s use of this information to communicate with you, and to consent to the purpose(s) for which Hostway may contact you or otherwise use your information. You may withdraw this consent at any time.

By Using Cookies

Our website uses cookies. These data files are read by our server to determine whether Users have visited our site before, how often, the length of time and which pages Users view. The systems we use to provide Services to Users may also place cookies on their computers. You may stop the use of tracking cookies by using the cookie consent banner on our website. However, even after opting-out, some cookies are still required for basic website functionality (for example, hiding notifications that have already been acknowledged). These basic cookies contain no identifying information and do not track visit data in any way.

Cookies used on the Hostway website (http://www.hostway.com) are listed below:

  • Google Analytics
  • ActiveCampaign
  • Facebook Ads
  • Google Ads

Note that the Facebook Ads and Google Ads cookies and tracking pixels collect information about your browsing activity on our website and transmit it to Meta Platforms, Inc. and Google LLC, respectively, for the purpose of delivering targeted advertising to you on third-party platforms. Under the CCPA, this transmission may constitute “sharing” of personal information for cross-context behavioral advertising. You may opt out of this sharing as described in the California Privacy Rights section below. Under the GDPR, this processing is based on your consent, which you may withdraw at any time through our cookie consent mechanism.

By Using Tracking Software

We may use software designed to track responses to our advertisements, other promotional activity, and movement throughout our site (“Tracking Software”). Tracking Software includes software such as web beacons and software used by our advertising partners.

By Log Files

Our website gathers Statistical Information automatically and stores it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We may combine this automatically collected log information with other information we collect about you.

WHERE DO WE KEEP YOUR INFORMATION?

We may store or access your personal information from any of our office locations, and therefore your personal information may be transferred, processed, or stored outside the jurisdiction in which it was collected. Where Hostway must transfer your personal information from the European Economic Area (EEA) or the United Kingdom to one of our office locations outside of the EEA or UK, Hostway will ensure that appropriate safeguards are in place as required by the GDPR and UK GDPR. These safeguards may include: (a) Standard Contractual Clauses (SCCs) approved by the European Commission (Commission Implementing Decision (EU) 2021/914), including the UK Addendum for transfers from the United Kingdom; (b) the EU-US Data Privacy Framework and, where applicable, the UK Extension to the EU-US Data Privacy Framework—Hostway has certified its compliance with the EU-US Data Privacy Framework as set forth by the U.S. Department of Commerce, and you may view our certification at https://www.dataprivacyframework.gov; (c) Binding Corporate Rules approved by a competent supervisory authority; or (d) an adequacy decision by the European Commission or UK Secretary of State for the recipient country. For transfers relying on SCCs, we conduct transfer impact assessments and implement supplementary measures where necessary to ensure an essentially equivalent level of protection. Copies of the relevant transfer mechanism documentation are available upon request by contacting our Data Protection Officer at privacy@hostway.com. If your personal information is governed by GDPR or UK GDPR, and you wish to obtain further details regarding the physical location of your information, you may contact Hostway’s Data Protection Officer at privacy@hostway.com.

HOW DO WE USE YOUR INFORMATION?

Automatically Collected Information

We use Statistical Information automatically collected by our website servers to help us analyze Web traffic, improve the content of our website and improve your experience on our website. Statistical Information is also used to operate our hardware and software, diagnose problems and administer our website. We may use aggregate Statistical Information to modify the products and services we offer based on who is visiting our website and what they are purchasing. Statistical Information alone will not enable us to identify a User personally.

Information Collected by Cookies

We use the information provided by cookies to change the way our website looks to Users, to keep Users logged in to certain areas of our website, to ensure continued connection to the systems, and to collect demographic data about where Users go on our website and how they behave. Cookies used by our systems are used to track and log activities on the systems and our network for security, network maintenance and other related activities. Information about Users collected by cookies may be combined with Statistical Information collected from Tracking Software, User Contact Information collected from sales or support inquiries, and other additional information collected in order to identify a User personally.

Information Collected by Tracking Software

We use the information collected by Tracking Software to determine the effectiveness of our marketing programs, improve the functionality of our website, and to collect demographic data about where Users go on our website and how they behave. Tracking Software may collect information about Users that, when combined with other Statistical or User Contact Information we have collected, will enable us to identify Users personally.

Information Provided by Users for Communications

We use the User Contact Information provided by you to send you general information about Hostway, details about our products and Services, publications related to our industry, and other promotional materials in which you have indicated an interest. You may opt out of receiving any such promotional communications from Hostway at any time by sending a request to newsletter-unsubscribe@hostway.com, by using the unsubscribe instructions included in each promotional communication, or, if you are a Client, by changing your e-mail preferences in the Client Portal.

Information Provided by Clients for Services

If you are a Client, we use your Client Information to establish our Services for you. This includes creating and maintaining your Client Account and your choice of Services, contacting you for customer and technical support purposes, and processing payment for the Services. We may also create and maintain Client logs in the normal course of providing Services to you. While you may opt out of receiving promotional communications from Hostway at any time, Clients may not opt out of receiving communications that are essential to your use of the Services, including communications from technical support, security and compliance, billing and account management, and system and network updates.

Payment Processing

Hostway uses third-party providers to provide credit card processing services through our online Client Portal. If you choose payment by credit card when you purchase our Services, we will share your Client Information as necessary for the third-party processor to provide the payment processing services. Please be assured that these third parties are prohibited from using your personal information for any other purpose including their own marketing services. These companies are authorized to use your personal information only as necessary to provide their services to us.

In response to a Subpoena or Other Legal Demand for Information

Hostway is required to comply with demands for information as required by state/provincial and federal law. Examples of these demands include subpoenas, warrants, and civil discovery demands. Information covered by our Privacy Notice may be disclosed following such a request if we determine, in our sole discretion, that such a disclosure is necessary or required. We may also disclose this information if (a) it is a matter or public safety or policy; (b) it is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by Hostway and appear to pertain to the commission of a crime; or (c) it is necessary or required to protect our interests or the interests of our other customers. We may not be able to notify you prior to any such disclosures.

CHILDREN’S PRIVACY

Hostway does not sell products or services for purchase by children. Clients must be at least 18 years of age. Our website and Services are not directed to children under the age of 18, and we do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18 without verification of parental consent, we will delete that information promptly. If you have reason to believe that a child under the age of 18 has provided personal information to us without the consent of their parent or guardian, please contact us immediately at privacy@hostway.com, and we will endeavor to delete that information and terminate any associated account from our databases.

THIRD-PARTY VENDORS AND PROVIDERS

We offer certain products and services that are provided by third-party vendors as a part of our Services, and we also use certain third-party providers ourselves in the course of our business (such as auditors, communications providers, customer relationship management providers, marketing agencies, and social media providers). This includes third-party widgets or other interactive mini-programs that run on our website that may set a cookie to enable that feature to function properly. These third parties may collect and use your information in ways that differ from those set out in this Privacy Notice. We require our service providers to process personal information only for the purposes we specify and in accordance with our instructions. Where required by applicable law, we enter into written agreements with these service providers that restrict their use and disclosure of personal information. If you choose to interact directly with any third-party by clicking on a widget or feature on our website, your interactions will be governed by such third-party’s own privacy policy. Certain third parties, including advertising networks such as Google Ads and Meta (Facebook) Ads, receive personal information from our website through cookies and tracking technologies. These third parties may use this information for their own purposes, including targeted advertising. Under the CCPA, these disclosures may constitute “sharing” of personal information. See the “California” section below for your opt-out rights.

If you are a Client, your Client Information will only be shared with third parties if it is necessary to provide the Services to you. Information in the Client Information related to payments, such as a User’s credit card number, is only used to ensure we receive payment for services rendered. Your User Contact Information may be shared with third parties only to the minimum extent necessary for the third parties to provide their services, either to you or Hostway (as applicable). The third-party vendors and providers that are incorporated as a part of our Services are not authorized to use any of your information for purposes beyond those specified by us, and they are required to preserve the confidentiality with which we treat such information.

Our website offers publicly accessible blogs. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog, contact us at privacy@hostway.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

SURVEYS OR CONTESTS

From time-to-time, we may provide you the opportunity to participate in contests or surveys on our website. If you participate, we will request certain User Contact Information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code). We use this information to notify contest winners and award prizes, to monitor website traffic or personalize the website (in the case of anonymous information collected in surveys), or to send participants an e-mail newsletter. We may use a third-party service provider to conduct these surveys or contests, and that company will be prohibited from using our Users’ personal information for any other purpose including their own marketing. User Contact Information collected from surveys or contests is not shared with third parties in ways that identify Users personally. To the extent we share Survey Information with third parties, it is done in aggregate.

CHAT FUNCTION

Our website may allow for a chat function. Chat functions allow you to participate in “live” online conversations with us on our Website. Although the transcripts from the chats may be stored internally on in-house servers for our records only, we collect no personal information about you when you participate unless you choose to provide that information to us.

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Your California Privacy Rights

  • Right to Know. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting or sharing it, and the categories of third parties with whom we have shared or sold it. For personal information collected on or after January 1, 2022, you may request this information beyond the 12-month period preceding your request, unless doing so proves impossible or would involve disproportionate effort.
  • Right to Delete. You have the right to request that we delete the personal information we have collected from you, subject to certain exceptions. Once we receive and verify your request, we will delete your personal information from our records and direct our service providers to do the same, unless an exception applies.
  • Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you. Upon receiving a verifiable request, we will use commercially reasonable efforts to correct the inaccurate information.
  • Right to Opt-Out of Sale/Sharing. You have the right to direct us to stop sharing your personal information for cross-context behavioral advertising at any time. To exercise this right, please e-mail us at privacy@hostway.com with the subject line “California Opt-Out of Sharing,” or use our cookie consent mechanism on our website to disable the relevant advertising cookies. We will process your opt-out request within 15 business days of receipt.
  • Right to Limit Use of Sensitive Personal Information. To the extent Hostway collects sensitive personal information as defined under the CCPA/CPRA, you have the right to direct us to limit the use and disclosure of your sensitive personal information to only those uses that are necessary to perform the services you have requested or as otherwise permitted by law. If you wish to exercise this right, please contact us at privacy@hostway.com.

Non-Discrimination

We will not discriminate against you for exercising any of your rights under the CCPA/CPRA. Unless permitted by the CCPA/CPRA, we will not deny you goods or services, charge you a different price or rate, provide you a different level or quality of goods or services, or suggest that you may receive a different price, rate, level, or quality of goods or services as a result of exercising your privacy rights.

How to Exercise Your Rights

To exercise your Right to Know, Right to Delete, or Right to Correct, please submit a verifiable consumer request to us by e-mailing privacy@hostway.com with the subject line “California Privacy Rights Request.” You may submit no more than two verifiable requests within a 12-month period.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request. When you submit a request, we will ask you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of such person. We will compare the information you provide with the information we have on file. The verification requirements may differ depending on the nature of the request and the sensitivity of the information requested.

You may designate an authorized agent to submit a request on your behalf. To use an authorized agent, you must provide the agent with written permission to submit requests on your behalf, and we may require you to verify your own identity directly with us. If an authorized agent submits a request on your behalf without providing proof of signed permission from you, we reserve the right to deny the request. We may deny a request from an authorized agent who does not provide proof that they are duly authorized to act on your behalf.

We endeavor to respond to a verifiable consumer request within 45 days of receipt. If we require more time, we will inform you of the reason and the extension period in writing. The extension period shall not exceed an additional 45 days (for a total of 90 days from the date of receipt). We will deliver our response electronically. If we cannot fulfill all or part of your request, our response will explain the reasons we cannot comply.

  • Right to Opt Out of Sale. You have the right to opt out of the sale of your personal data. Hostway does not sell your personal data for monetary consideration. If we decline to take action on your request, we will inform you of our decision and the reasons for it within the timeframe required by applicable law. You have the right to appeal our decision by submitting a written appeal to privacy@hostway.com with the subject line “State Privacy Rights Appeal.” We will respond to your appeal within 45 days of receipt, or such other period as required by the law of your state. AUTOMATED DECISION-MAKING AND PROFILING

Hostway may use automated tools and technologies in the course of providing our Services and operating our business. Specifically, we may use automated tools for purposes such as fraud detection, security monitoring, and service optimization. These automated tools help us protect the integrity of our network and improve the quality of our Services.

Hostway may use artificial intelligence tools, including AI-powered chatbots and virtual assistants, to triage, respond to, and resolve initial customer support inquiries and helpdesk tickets. When you submit a support request through our website, Client Portal, chat function, or e-mail, your initial interaction may be handled by an automated AI system rather than a human agent. The AI system may process the contents of your inquiry, including any User Contact Information or Client Information you provide, in order to understand your request, suggest resolutions, route your ticket to the appropriate team, or generate a response. You may request to be transferred to a human support agent at any time by replying to the AI-generated response with a request to speak with a person, or by contacting us directly at support@hostway.com.

Hostway does not use automated decision-making processes, including profiling, that produce legal or similarly significant effects on individuals without human review. Any automated process that could result in a decision materially affecting your access to or use of our Services is subject to human oversight and review.

If you believe that an automated decision has been made about you, you have the right to request that a human being review that decision. To submit such a request, please contact us at privacy@hostway.com with the subject line “Request for Human Review of Automated Decision.”

Additionally, to the extent that Hostway uses automated tools to process your personal information for purposes of targeted advertising or profiling, you have the right to opt out of such processing. To exercise this right, please contact us at privacy@hostway.com or use our cookie consent mechanism on our website to disable the relevant advertising and tracking cookies.

SENSITIVE PERSONAL INFORMATION

Certain applicable privacy laws, including the CPRA and various US state privacy laws, define a category of “sensitive personal information” that receives heightened protection. Sensitive personal information generally includes, but is not limited to: Social Security numbers and other government-issued identification numbers; financial account information such as bank account numbers, credit card numbers, and debit card numbers; precise geolocation data; racial or ethnic origin; religious or philosophical beliefs; union membership; the contents of mail, e-mail, or text messages unless Hostway is the intended recipient; genetic data; biometric information processed for the purpose of uniquely identifying an individual; information concerning health or medical conditions; and information concerning a person’s sex life or sexual orientation.

Hostway collects limited categories of sensitive personal information. Specifically, we collect financial information, such as credit card numbers and banking information, solely for the purpose of processing payments for our Services. We do not collect sensitive personal information such as biometric data, precise geolocation, health or medical information, genetic data, or information about racial or ethnic origin, religious beliefs, union membership, sexual orientation, or the contents of your private communications.

The limited sensitive personal information that we do collect is used solely for the purposes necessary to provide the Services to you, and is not used for any secondary commercial purposes, including targeted advertising, unless you provide separate, explicit consent.

You have the right to request that Hostway limit the use and disclosure of your sensitive personal information to only those purposes that are necessary to perform the Services you have requested, or as otherwise permitted by applicable law. To exercise your right to limit the use of your sensitive personal information, please contact us at privacy@hostway.com with the subject line “Limit Use of Sensitive Personal Information.” We will respond to your request within the timeframe required by applicable law.
